your realtime captioner is mrs. linda m. macdonald he had a really cold just blank look on his face. >> a moment of terror as this man comes face to face with a gunman at los angeles international airport, runs out of the terminal without his shoes on. what we're learning about why the suspect opened fire. bart unions give the official okay to new contracts. what has to happen now before they go into effect. and don't look now. the holiday shopping deals are already out. why retailers are starting now instead of waiting until black friday. good evening, i'm ann notarangelo. just over an hour ago, federal murder charges were filed against the gunman in the shooting at los angeles international airport. tonight witnesses recount the terrifying moments including one man who came face to face

with the gunman. >> i went and kind of cowered in a corner and the shooter was just calmly walking down the corridor. he saw me cowering there. he had his gun and he look at me and he said, tsa? and i just shook my head. and he kept going. >> the shooting left one tsa agent dead and five other people including the gunman paul ciancia injured. there are new details on ciancia. he is in the hospital in critical condition. and we have learned that see ciancia was shot in the head. he lives in los angeles but originally is from new jersey. teri okita reports. >> reporter: authorities actually say that someone dropped ciancia off here at

l.a.x. before this shooting. he then went inside and shot a tsa multiple times at point- blank range. he then went up an escalator, came back and shot the officer again. as you mentioned, tonight, husbands driving widow remembered her husband. >> reporter: the widow of the fallen tsa officer spoke to the media saturday. >> gerardo would have been 40 next week. i am truly devastated. and we are all heartbroken. >> reporter: the head of the tsa expressed his condolences on behalf of the agency. >> officers hernandez was the first tsa employee killed in the line of duty. >> on the floor, on the floor now! >> reporter: hernandez was killed in a shooting rampage at los angeles international airport friday morning. four other people were wounded. a wreath was delivered to l.a.x. saturday where there's a visible police presence in car,

on foot and on bicycles. >> we saw a lot of policemen around so i'm feeling good. >> reporter: a blue tarp cordoned off the security checkpoint where authorities say 23-year-old paul ciancia opened fire. the fbi wrapped up its forensic investigation and cleaning crews were brought in to sanitize the area. >> we want to make sure when people walk in that the place is pristine and no evidence of incidents that occurred. >> reporter: terminal 3 is now completely operational but some baggage was left behind during friday's chaos. passengers are encourage to work with their airlines to claim their belongings. ciancia had some baggage of his own. authorities say he was carrying five fully loaded magazines. that's 180 rounds. and more ammunition was found in a bag nearby. police shot ciancia four times. he is recovering in police custody. the fbi says ciancia is receiving medical attention but is unresponsive and they are unable to interview him at this

time. they also say that that murder charge could potentially carry the death penalty. reporting live from los angeles, i'm teri okita. >> have authorities talked about security that might have been able to prevent this shooting? >> reporter: yeah. that's a good question. the l.a. airport police chief did speak a little bit about that today. he said that he does think that they had adequate manpower to handle this, that recently the officers, several hundred of them, were retrained in emergency situations just like this. that being said, he did note that there were about -- they were about 17 officers under the number that's actually allocated for the department. but he doesn't think that made a difference. as far as the tsa goes, right now, agents are not required or allowed to carry weapons. and from what the tsa administrator told us today, that does not appear to be a policy that they are about to change anytime soon. >> teri okita in los angeles, thank you. more than 1500 flights have

been affected by the shooting at l.a.x. we checked sfo's website this afternoon. and there were no significant delays as far as departures go. most of the flights coming out of los angeles are running on time but we did find some lengthy delays for virgin america which also canceled a flight this morning to san jose. southwest canceled one flight to oakland this afternoon. late last night, bart's largest union voted to accept a contract that gives them a raise and improved working conditions. the agreement comes after months of negotiations and two crippling strikes. don knapp is at the daly city bart station with details. >> reporter: you may recall during the negotiations when bart introduced the last-minute push for work rule changes, talks stopped. now we have learned that bart got those work rule changes it wanted and the unions got safety rules they wanted. reporter: bart riders were mostly just glad the strike is over and the contracts have

been ratified. but there's lingering anger over workers strike that tied up the bay area. >> it was a very difficult situation for a couple of days and a lot of people were pretty heavily inconvenienced, but collective bargaining is important. >> reporter: work and safety rules that nearly torpedoed the talks got renewed attention after two workers were killed, struck by a train on the bart tracks. the deaths may have helped end the strike. >> it's most unfortunate but, yes, there was a lot of light shed on the real safety issues that are going on with bart. >> reporter: she says 88% of seiu's 1400 members approved the contract and says work safety was a big reason. >> our people are the people that step on the tracks and they do this every day to make sure that those tracks are clear for the trains as they pass through. they are also the workers who have to deal with 1,000 volts every day. >> reporter: bart management says work rule changes played a role. >> so when management tries to manage in the old contract we were only able to do it with

the union's approval so management never was able to manage under the old contract. this was an essential provision for up to move forward and let management help shade where we immediate to go. >> reporter: the train operators union which includes station agents also ratified the contract by more than 85%. >> i think it was an overwhelming understanding of what was on the table. you know, an understanding that at this point was what was going on that a deal needed to be done. >> reporter: all workers will see a 15% pay raise over 4 years. the workers will also begin to help pay for their own pensions and healthcare up to a 4% contribution by the end of the four years. and work under new safety rules. bart's board of directors is expected to ratified the agreement or at least to vote on the agreement before the regularly scheduled meeting november 21. reporting live in daly city, don knapp, kpix 5. >> the much smaller afscme union hasn't voted yesterday every yet. one of the two men killed on the tracks belonged to that

union. a pleasanton man badly beaten outside his home has awakened from a medically- induced coma. around midnight, on september 20, david lamont went outside to ask teens to quiet down. when he didn't return, his wife went out and found him beaten and unconscious. doctors say his condition is no longer life-threatening but he is still not able to speak. the investigation is on hold until police can question him. the san francisco city gardener charged with fatally running over a woman in holly park has been fired. on september 5, police say thomas burnoski drove his vehicle over christine svanemyr as she lay on the grass with her baby and dog. he is charged with vehicular manslaughter and hit-and-run. he pled not guilty. he has worked for the city's park and recreation department for 7 years. dozens of people along with their four-legged friends made their voices heard today about a plan to limit access to three popular spots in san francisco. the golden gate national recreation area wants to cut

off parts of ocean beach, crissy field and fort funston to dogs. in other bay area locations activists say dogs would have no access. the plan is open to public comment but dog lovers fear this could just be the beginning. >> they are basically closing off more and more of these areas to recreation not just people with dogs. so we -- so if they kicked everybody out with dogs, they will kick out other users, as well. >> an open house was held today at the fort mason center for people to weigh in on the dog walking plan. a honda recall. the problem that can cause vehicles to brake suddenly. >> big changes at school performances on the east coast. why they are banning christmas music. >> roberta gonzales in the kpix 5 weather center. good evening, everybody. let's take a bird's-eye view of the city of san francisco where today's high was 60 degrees. now the cooldown and the day the chances of rain increases as the news continues on kpix 5.

braking problem. the recall affects the 2007 and 2008 model year honda odyssey minivans. the software and parts problem can cause hydraulic pressure to build up in the braking system and the build-up can cause heavy and unexpected braking. replacement parts will be available early next year. in the meantime, honda has information online about how to prevent the problem from happening. the holidays are coming and so are the holiday concerts but one new jersey school district is banning religious music in the concerts. the bordentown regional school district says some of the music selections at two elementary schools shows have led to a legal review so they are banning songs about the religious meaning of christmas. >> to be on the safe side. it could be offensive to other parents, families, because there are so many different religions out there. >> i think the holidays in america is the melting pot. kwanzaa, chanukah, christmas. let them sing it all. >> the u.s. supreme court declined to hear an appeal of a
